Terms of Use

These Terms govern the use of the Pesca PRO app and services. By creating an account or using the platform, you confirm that you have read and agree to what is described here. If you do not agree, please do not use the service.

1. What Pesca PRO is

Pesca PRO is an organisation platform for boat fishing trips. It connects fishing operations, captains and anglers, providing a trip schedule, share control, communication and payment intermediation.

Pesca PRO is not the provider of the fishing service. The fishing operation you hire is the party that runs the trip, operates the boat and answers for it.

Pesca PRO is a product of Fluxory Tecnologia (www.fluxory.com.br), which is responsible for developing and operating the platform.

2. Who can use it

• People aged 18 or over with legal capacity.
• Duly constituted fishing operations, responsible for the boats they register.

Minors may only take part accompanied by a guardian, subject to the operation's rules.

3. Account and access

• Access is by mobile number, with a code sent via SMS.
• You are responsible for keeping your number up to date and for not sharing access.
• False or third-party information may lead to account suspension.

4. Shares, lists and boat rules

Each boat sets its own rules: share price, payment and withdrawal deadlines, number of places, waiting list and boarding conditions. These rules are visible before you request a share, and your acceptance is recorded with date and time.

• Requesting a share reserves your place on the trip, subject to that boat's rules.
• When the list is full, you may join as a substitute and be confirmed if someone leaves.
• The payment deadline is set by the boat: a few days before the trip or immediate payment (within 1 hour of the request). The app shows the deadline and reminds you before it expires.
• A share not paid within the deadline is released automatically; the place goes to the waiting list or, if there is none, is offered to those following the boat.
• Anyone who withdraws from a share or loses it for non-payment cannot request the same trip again.
• If the operation changes the destination, the share price becomes that of the new destination: any overpayment becomes credit in your wallet; if it costs more, the angler pays the difference.

5. Payments

Payments are processed through a partner payment institution. Pesca PRO intermediates the charge and the transfer but does not store card data: when paying by card, details are entered directly on the processor's secure page.

• The share price is set by the fishing operation, according to the destination and the day of the trip.
• The payment method fee (instant transfer or card) is added to the share price and shown before confirmation.
• For card instalments, the cost of each option is shown before you choose. The operation may accept cards only until a few days before the payment deadline; after that, instant transfer (PIX) only.
• The amount paid goes into the operation's payment account, as the operation provides the service. Pesca PRO receives a platform fee, agreed with the operation and deducted automatically from each payment; its amount is shown in the terms you accept when requesting the share.

6. Cancellation, withdrawal and refunds

• Angler withdrawal: follows the deadlines and conditions of the boat, shown when the share is accepted.
• Cancellation by the operation (weather, safety, minimum number of anglers): the operation chooses between refund and credit.
• Refunds: where applicable, the amount returns as credit in your wallet for that operation, usable on another trip of theirs.
• A reversal (return to the original payment method) is an exception, at the operation's discretion: it returns the amount paid for the share minus the platform fee. The platform fee and the payment method fees are non-refundable.
• Once the operation withdraws the amount from its payment account, a refund through the app is no longer possible; amounts already withdrawn are settled directly with it.

Wallet credit is per operation: credit earned with one operation cannot be used with another.

7. Responsibility for the fishing trip

The fishing operation is fully responsible for the boat, the crew, safety equipment, required licences and the conduct of the trip, including compliance with applicable environmental and navigation law.

The angler must follow the captain's instructions, on-board safety rules and the boat's rules. Failing to do so may result in disembarkation without refund.

8. Expected conduct

The platform may not be used to:

• Provide false information or impersonate another person.
• Offend, threaten or harass other users in the chat.
• Arrange payments outside the app in order to bypass the rules agreed with the operation.
• Attempt to access data or features that do not belong to you.

Operations may restrict specific anglers from joining their trips.

9. Closing your account

You may delete your account from within the app. We may suspend or close accounts that breach these Terms. Once closed, we keep only the records required by law or needed to evidence financial transactions already carried out.

10. Availability and changes

We work to keep the service available, but it may undergo maintenance and downtime. We may change features and these Terms; relevant changes are announced in the app with reasonable notice.

11. Limitation of liability

Pesca PRO is responsible for the operation of the platform. We are not liable for accidents, losses, damages, delays, cancellations or any occurrence during the fishing trip, which are the responsibility of the operation you hired. We are also not liable for arrangements made outside the app between angler and operation.

12. Governing law and jurisdiction

These Terms are governed by Brazilian law, including the Consumer Protection Code and the General Data Protection Law (Law 13,709/2018). The consumer's place of residence is the elected jurisdiction for any disputes.
